Talking point: The case before the Ontario Superior Court is the first of its kind in Canada. News publishers, including The Canadian Press, Torstar, The Globe and Mail, Postmedia and CBC, argue the generative AI system breached copyright laws by scraping content from Canadian media to train ChatGPT, profiting off their stories without permission or compensation. (The Logic is not part of this lawsuit or any other against an AI company.) Although ChatGPT is available to users in Ontario, OpenAI says the company doesn’t do business in the province. Headquartered in San Francisco, OpenAI incorporated all of its subsidiaries under Delaware’s laws. If the case moves south of the border, the news publishers argue it could set a precedent that sees Canada surrender jurisdiction over a large part of its digital economy.
