The Liberty Justice Center filed a claim with the U.S. Court of International Trade in New York to challenge President Donald Trump’s use of a Depression-era statute to impose additional tariffs on nearly $28 billion worth of Canadian goods after trade talks between the two countries collapsed. (The Logic)
Talking point: No other president has ever imposed tariffs under Section 338 of the Tariff Act of 1930, also known as the Smoot-Hawley Tariff Act. The Liberty Justice Center, a non-profit law firm that successfully challenged the earlier fentanyl-related tariffs in the U.S. Supreme Court, filed the latest lawsuit on behalf of Gellert Global Group, a food importer based in New Jersey. The non-profit argues the 96-year-old law has been superseded by more recent tariff authorities that grant more oversight to U.S. Congress and that using it in this way is hurting American businesses and consumers. The White House did not immediately respond to a request for comment.
