The Federal Communications Commission’s December 2020 reaffirmation that the Chinese telecommunications company is a security threat is “arbitrary, capricious, and an abuse of discretion, and not supported by substantial evidence,” according to the lawsuit, which Huawei filed in the U.S. Court of Appeals for the Fifth Circuit. Talking point: The suit came hours before Huawei CEO Ren Zhengfei expressed hope that the Biden administration “would have an open policy for the benefit of American firms and the economic development of the United States.” Justin Trudeau has also pressed the Biden administration on Huawei, if only to help secure the release of Canadians Michael Kovrig and Michael Spavor. The two men were arrested and imprisoned in 2018 in an apparent retaliation for Canada’s arrest of Huawei CFO Meng Wanzhou.
