Talking point: “It’s important to note that this appeal won’t stop the sale,” the group said on its website. Instead, it seeks to have the Court of Appeal find that the creditor-protection process “should not be used to remove the rights of co-op members/owners to be involved in major decisions about the future of their co-op.” Such a decision “could safeguard every other co-op in Canada,” it said, as well as potentially propel moves toward taking back the co-op. Meanwhile, Kingswood Capital Management and MEC continue to work toward the closing of their transaction, which is scheduled for October 30. A judge approved the deal, which MEC’s board unanimously approved after it said it exhausted all other options, in early October as part of a CCAA process. Save MEC had asked the judge for a two-week adjournment to finalize an alternate proposal, but was denied the request.
