Talking point: Uber has been fighting the proposed class action since it was filed in 2017. The company was granted a stay on the case in 2018 (at the time, Uber required all legal disputes to be mediated in the Netherlands where it used to be incorporated). After the Ontario Court of Appeal reversed the stay in 2019, Uber took it to the Supreme Court and lost. A lawyer representing the class said a win for the drivers would be a “landmark decision” that would “change the landscape of employment” and how gig workers are classified. The case is one of several in the province in which contractors of Big Tech firms have sought better pay and benefits through employment status. Last year, Foodora couriers in Toronto won a historic case granting them the right to unionize; two months later, the company announced it was leaving the Canadian market, citing tough competition.
