U.S. federal judge Yvonne Gonzalez Rogers denied Epic Games’ request for a temporary restraining order that would have forced Apple to restore its game Fortnite to the App Store. However, she ruled that Apple could not remove Epic from its developer program. (The Logic)
Talking point: This is a split decision, but a temporary one. Rogers has scheduled a September 28 hearing to consider which Epic Games products, if any, Apple can ban while the broader court case is decided, which could take five years. This all started August 13 when Epic stopped paying Apple and Google their commissions for in-app purchases on Fortnite and both firms removed the game from their stores. Epic Games CEO Tim Sweeney has been battling big tech for years and previously challenged Microsoft for its own app store policies. Microsoft is now supporting Epic in its court fights against Apple. Spotify and Match Group are also supporting Epic. Apple, by contrast, won a similar antitrust case in front of Rogers back in 2013.
