Talking point: MindGeek had argued it shouldn’t be held liable for what is uploaded to its sites, and that it should be afforded the same protections over user-generated content as Section 230 affords Facebook and YouTube. Yet Coogler said MindGeek in fact has “instructed uploaders and users, down to a granular level, on how to create content” and that the company are “not merely publishers of third party-created content” and therefore not entitled to Section 230 immunity. The lawsuit, filed in February 2021, is based on separate allegations from two women that videos of them being sexually assaulted and abused as teenagers were posted on Pornhub and other MindGeek-owned sites.
