Talking point: There are two disagreements here, one tactical and the other political. Some DoJ lawyers want to file a complaint focusing on both Google’s advertising and search businesses, while others preferred picking one. Some raised concerns that rushing a case would make it less likely to succeed. Most lawyers working on the case objected to Barr’s deadline, and some said they wouldn’t sign it. Politically, state attorneys general have disagreed about whether to file a case while Donald Trump is president or wait until after the election, which could trigger a change in leadership. There’s currently a group of 50 states and territories in support of some kind of antitrust action against Google, but some may not back the Justice Department’s case depending on its timing and scope.
