In a preliminary injunction decision released Friday, a federal judge called the state-level bill, which would require adult-content websites to verify a user’s age, poorly defined and unconstitutional—possibly limiting the First Amendment rights of both users and adult-content creators. Talking point: The judge also reasoned the bill could put people wanting to view homosexual intercourse at risk “given Texas’s ongoing criminalization of homosexual intercourse.” Other states such as Louisiana have passed similar age-verification laws and it’s likely Texas will appeal. The injunction comes after advocates and a group of adult-industry sites, including Pornhub, a site of Aylo—formerly MindGeek—sued Texas. Meanwhile, a federal judge granted a preliminary injunction Thursday against forcing social media companies to verify users’ ages, also citing possible unconstitutionality after a Big Tech challenge.
