The Vancouver-headquartered athleisure company filed a lawsuit Friday in a U.S. district court in California, accusing Costco of replicating several of its products with one intended goal to “confuse consumers.” Lululemon is seeking payment from Costco for allegedly profiting off its designs. Talking point: Lululemon is under growing pressure as more affordable workout clothes flood the market. The 49-page lawsuit contained full-colour photos and sketches of Lululemon’s Define jacket, Scuba hoodie and the wildly popular men’s ABC dress pants, compared side-by-side with Costco’s products—many of which are being sold for a fraction of the price of Lululemon’s gear. In the past, the yoga-pant maker has pushed back against dupes, even holding a “dupe swap” in 2023, where it told customers to bring in replicas of their Align leggings and switch them for the real thing.
