The agency on Thursday published an advanced notice of proposed rulemaking, seeking public feedback on questions about how firms’ collection and use of personal information harms consumers; how to prevent errors and bias from automated-decision making systems; and what data and algorithm disclosures it should require. (The Logic)

Talking point: Federal Trade Commission (FTC) chair Lina Khan has built her regulatory thesis on reworking antitrust ideas about monopolies and market power for the digital economy, and on the behaviour of Big Tech firms in particular. “Businesses now collect personal data on individuals at a massive scale, and in a stunning array of contexts,” she said at a press conference Thursday, citing examples like location, health and purchase information. But other policymakers have labelled this approach “hipster antitrust,” calling for competition policy to stay out of fields like privacy and inequality. (The FTC voted to move forward with its data study split on partisan lines, with the two Republicans opposed.) The agency’s move is particularly significant because the U.S. lacks a federal consumer privacy law, although a bill is slowly working its way through Congress.
